- hereinafter referred to as “Provider” -
1. Scope
The following Terms and Conditions (T&C) apply to all contracts and deliveries between the Provider and a consumer or professional dealer in the version valid at the time of order.
Entrepreneur means a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
A Consumer is any natural person who enters into a legal transaction for purposes which are predominantly outside their trade, business, or profession.
2. Conclusion of Contract and Storage of the Contract Text
2.1 The offers in the online shop represent a non-binding invitation by the Provider to submit an offer to purchase the presented Goods, including customized products.
2.2 Ordering process:
- Selection of the Goods
- Individual adjustments or configuration of the Goods (if applicable)
- Adding items and quantities to the shopping cart
- Reviewing the shopping cart
- Providing billing and delivery addresses
- Choosing the payment method
- Summary of the order data, with the option to check and correct entries
- Final submission by clicking the button “order for a fee”, only possible after confirming agreement with these T&C and the Privacy Policy
2.3 By submitting the Order, the customer makes a binding contractual offer. The contract is concluded when the Provider accepts the order by (i) order confirmation (email or text form), or (ii) delivery of the Goods, or (iii) request for payment. The contract is binding at the time one of these events first occurs.
2.4 The order data are stored by the Provider and can be viewed in the customer account at any time. In addition, the Provider will send the contract text to the customer in text form (e.g., email). Beyond this, the contract text is not accessible.
2.5 The following languages are available for the conclusion of the contract: German, English.
3. Prices, Shipping Costs, Payment, Due Date
3.1 All prices shown in the online shop include statutory VAT, displayed separately on the invoice, plus any applicable shipping costs indicated during the order process.
3.2 Payment is made using the payment method specified by the customer in the order process. If prepayment is required, production or customization begins only after receipt of payment. Orders subject to prepayment are reserved for a maximum of 14 days; if payment is not received, the order will be canceled.
4. Delivery
4.1 Delivery will take place within the delivery time indicated in the product description. For customized or individually produced items, the delivery period is extended by the time needed for production or adaptation. Goods in stock without customization are usually ready to ship immediately; otherwise, they are generally shipped within 14 working days.
4.2 Orders are processed and delivered only after receipt of payment when prepayment has been agreed. If the last day of the delivery period falls on a Saturday, Sunday, or public holiday, the deadline is extended to the following working day.
4.3 Delivery delays due to force majeure will be communicated as soon as known and do not entitle the customer to withdraw from the purchase.
4.4 Upon delivery of the Goods, the risk of accidental loss or deterioration passes to the customer. The same applies if the customer is in default of acceptance.
4.5 Self-collection of purchased Goods is excluded.
5. Retention of Title
The purchased Goods remain the property of the Provider until full payment of the purchase price.
6. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal for distance contracts and contracts concluded outside business premises. Details are provided in the cancellation policy, which is made available to consumers before the contract is concluded.
7. 2-Year Limited Warranty
Every item is warranted against manufacturing defects for a period of 2 years from the date of purchase. If a jewelry piece is returned during the warranty period, any defect resulting from a manufacturing defect will be repaired (if feasible) or replaced free of material (excluding diamonds) and labor charges, at the Provider’s discretion.
The warranty only covers manufacturing defects. It does not cover defects or damages caused by misuse, negligence, or accidents.
To make a claim, customers must contact hello@persn.com with proof of purchase or order number and photos of the defective piece. Upon approval, the Provider will send a return shipping label and instructions for sending the package. Items sent back without prior approval will not be accepted.

8. Warranty for Defects (Statutory Rights)
In addition to the above limited warranty, statutory provisions on liability for defects apply to consumers and entrepreneurs.
9. Liability and Indemnification
9.1 The Provider is liable without limitation:
- for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty by the Provider or its legal representatives or vicarious agents;
- for damages caused by intentional or grossly negligent breach of duty by the Provider or its legal representatives or vicarious agents;
- under a guarantee promise, if no other agreement has been made;
- due to mandatory liability (e.g., under the Product Liability Act).
9.2 In the case of negligent breach of essential contractual obligations, liability is limited to foreseeable, typical damages, unless unlimited liability applies under the preceding paragraph. Essential contractual obligations are obligations that enable the proper execution of the contract and on which the customer may rely.
9.3 Otherwise, liability of the Provider and its representatives or vicarious agents is excluded.
9.4 The customer indemnifies the Provider against any claims by third parties – including legal defense costs at the statutory rate – arising from unlawful or contractual violations by the customer.
10. Data Protection
The Provider treats personal data of its customers confidentially and in accordance with statutory data protection regulations. Further details are provided in the Provider’s Privacy Policy.
11. Final Provisions
11.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, provided that this choice of law does not deprive a consumer with habitual residence in the EU of the protection of mandatory provisions of the law of their country of residence.
11.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the court at the Provider’s registered office shall have jurisdiction, unless an exclusive place of jurisdiction is established. This also applies if the customer has no place of residence within the EU.
11.3 Should any provision of this contract be invalid or unenforceable, the remaining provisions remain unaffected.
12. Online Dispute Resolution / Consumer Mediation
The Provider is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
